Puertas ARSE, controller of the website, hereinafter the CONTROLLER, makes this document available to users in order to comply with the obligations laid down in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), and to inform all users of the website of the conditions of use.
Anyone who accesses this website assumes the role of user and undertakes to observe and strictly comply with the provisions set out herein, as well as any other applicable legal provision.
Puertas ARSE reserves the right to modify any information that may appear on the website, without any obligation to notify users in advance. It is sufficient to publish these changes on the website of Puertas ARSE.

Through the Website, we offer Users access to information about our services.
3. PRIVACY AND DATA PROCESSING
When access to certain content or services requires personal data, Users shall guarantee that the data are true, accurate, authentic and up to date. The company will give those data the automated processing that corresponds to their nature or purpose, on the terms indicated in the Privacy Policy section.
4. INDUSTRIAL AND INTELLECTUAL PROPERTY
The User acknowledges and accepts that all content displayed on the Web Space and in particular designs, texts, images, logos, icons, buttons, software, trade names, trademarks, or any other signs capable of industrial and/or commercial use are subject to Intellectual Property rights, and that all trademarks, trade names or distinctive signs, and all industrial and intellectual property rights over the contents and/or any other elements inserted on the page, are the exclusive property of the company and/or third parties, who have the exclusive right to use them in the course of trade. The User therefore undertakes not to reproduce, copy, distribute, make available or otherwise communicate to the public, transform or modify such content, holding the company harmless from any claim arising from a breach of those obligations. Access to the Web Space does not in any case imply any waiver, transfer, licence or total or partial assignment of those rights, unless expressly stated otherwise. These General Conditions of Use of the Web Space do not confer on Users any other right of use, HR, alteration, exploitation, reproduction, distribution or public communication of the Web Space and/or its Contents other than those expressly provided herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for that purpose by the company or the third-party holder of the rights concerned.
The contents, texts, photographs, designs, logos, images, computer programs, source codes and, in general, any intellectual creation existing in this Space, as well as the Space itself as a whole as a multimedia artistic work, are protected as copyright by intellectual property legislation. The company owns the elements that make up the graphic design of the Web Space, the menus, navigation buttons, HTML code, texts, images, textures, graphics and any other content of the Web Space or, in any case, holds the corresponding authorisation to use those elements. The content provided on the Web Space may not be reproduced in whole or in part, nor transmitted, nor recorded by any information retrieval system, in any form or by any means, unless prior written authorisation has been obtained from the said Entity.
It is also forbidden to remove, circumvent and/or manipulate the “copyright” as well as the technical protection devices, or any information mechanisms that the contents may contain. The User of this Web Space undertakes to respect the rights set out and to avoid any action that could harm them, the company reserving in any case the exercise of whatever legal means or actions correspond to it in defence of its legitimate intellectual and industrial property rights.
5. OBLIGATIONS AND RESPONSIBILITIES OF THE USER OF THE WEB SPACE
The User undertakes to:
- Make appropriate and lawful use of the Web Space and of its contents and services, in accordance with: (i) the legislation applicable at any time; (ii) the General Conditions of Use of the Web Space; (iii) generally accepted morals and good customs; and (iv) public order.
- Provide all means and technical requirements needed to access the Web Space.
- Provide truthful information when completing the forms contained in the Web Space with their personal data and keep them updated at all times so that they correspond, at all times, to the User’s real situation. The User shall be solely responsible for any false or inaccurate statements made and for any damage caused to the company or to third parties by the information provided.
Notwithstanding the foregoing, the User shall also refrain from:
- Making unauthorised or fraudulent use of the Web Space and/or the contents for unlawful purposes or effects, prohibited in these General Conditions of Use, harmful to the rights and interests of third parties, or which in any way may damage, disable, overload, deteriorate or prevent the normal use of the services or of the documents, files and all kinds of contents stored on any computer equipment.
- Accessing or attempting to access resources or restricted areas of the Web Space without meeting the conditions required for such access.
- Causing damage to the physical or logical systems of the Web Space, its suppliers or third parties.
- Introducing or spreading on the network computer viruses or any other physical or logical systems that are liable to cause damage to the physical or logical systems of the company, suppliers or third parties.
- Attempting to access, use and/or manipulate the data of the company, third-party suppliers and other Users.
6. LIABILITY
Continuous access is not guaranteed, nor the correct viewing, downloading or usefulness of the elements and information contained on the website, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. It is not responsible for decisions that may be taken as a result of access to the contents or information offered.
The service may be interrupted, or the relationship with the User terminated immediately, if it is detected that any use of its Web Space, or of any of the services offered on it, is contrary to these General Conditions of Use. We are not liable for damages, losses, claims or expenses arising from the use of the Web Space.
It shall only be responsible for removing, as soon as possible, the contents that may give rise to such harm, provided that it is notified. In particular we shall not be liable for harm that may arise, among other things, from:
- Interference, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in telecommunications lines and networks, or by any other cause beyond the company’s control.
- Unlawful intrusions through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any others.
- Improper or inappropriate abuse of the Web Space.
- Security or browsing errors caused by a malfunction of the browser or by the use of outdated versions of it. The administrator of the web space reserves the right to withdraw, in whole or in part, any content or information present on the Web Space.
The company excludes any liability for damages of any kind that may be due to misuse of the freely available services by Users of the Web Space. It is likewise released from any liability for the content and information that may be received as a result of the data collection forms, these being used solely for the provision of enquiry and query services. If damage is caused by an unlawful or incorrect use of those services, the User may be claimed against for the damage caused.
You shall hold the company harmless against any damages arising from claims, actions or demands by third parties as a result of your access to or use of the Web Space. You also undertake to indemnify it against any damages arising from your use of “robots”, “spiders”, “crawlers” or similar tools used to collect or extract data, or from any other action on your part that imposes an unreasonable burden on the operation of the Web Space.
7. DATA PROTECTION
To use some of the Services, the User must first provide certain personal data. The company will process these data automatically and apply the corresponding security measures, all in compliance with the GDPR, LOPDGDD and LSSI. The User may access the policy followed in the processing of personal data, as well as the previously established purposes, under the conditions defined in the Privacy Policy.

Therefore, in offering them, no warranty or representation is given in relation to the contents and services offered on the Web Space, including, by way of example, warranties of lawfulness, reliability, usefulness, truthfulness, accuracy or merchantability, except to the extent that such representations and warranties cannot be excluded by law.
10. FORCE MAJEURE
The company shall not be liable in the event of impossibility of providing the service if this is due to prolonged interruptions of the electricity supply, telecommunications lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure or fortuitous event.
11. DISPUTE RESOLUTION. APPLICABLE LAW AND JURISDICTION
These General Conditions of Use, as well as the use of the Web Space, shall be governed by Spanish law. For the resolution of any dispute the parties shall submit to the Courts and Tribunals of the registered office of the Controller of the website.
If any stipulation of these General Conditions of Use is unenforceable or void under applicable law or as a result of a judicial or administrative decision, such unenforceability or invalidity shall not render these General Conditions of Use unenforceable or void as a whole. In such cases, the company shall modify or replace that stipulation with another that is valid and enforceable and that, to the extent possible, achieves the objective and intent reflected in the original stipulation.
